Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TrendPilot platform, websites, and services (collectively, the "Service") provided by Trend Pilot Corp. ("TrendPilot," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TrendPilot provides an analytics platform that helps marketers connect third-party services and view, understand, and act on data from those services. We may add, change, or remove features, integrations, and functionality at any time to improve the Service.

2. Eligibility and Accounts

You must be at least the age of majority in your province or territory and able to form a binding contract to use the Service. You are responsible for the information you provide, for maintaining the confidentiality of your login credentials, and for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised.

3. Connected Third-Party Services

The Service lets you connect accounts from third-party platforms that you authorize. Your use of those platforms remains subject to their own terms and policies, and you are responsible for having the necessary rights and permissions to connect them and to allow us to access the associated data on your behalf. We are not responsible for third-party services, their availability, or changes they make to their platforms or data access. You may disconnect any connected account at any time.

4. Acceptable Use

You agree not to misuse the Service. You will not use the Service to violate any law or the rights of others; attempt to gain unauthorized access to the Service, other accounts, or connected systems; interfere with or disrupt the integrity or performance of the Service; reverse engineer, copy, or resell the Service except as permitted by law; or upload or transmit malicious code. We may suspend or limit access to protect the Service or other users.

5. AI-Generated Features

The Service includes features that use artificial intelligence to generate insights, summaries, and recommendations from your data. These outputs are provided to assist you and may contain inaccuracies or omissions. You are responsible for reviewing and independently verifying any output before relying on it, and AI-generated content does not constitute professional, financial, or business advice.

6. Fees and Subscriptions

Some features of the Service may require a paid subscription. Applicable fees, billing cycles, and plan details will be presented to you at the time of purchase. Unless otherwise stated or required by law, fees are non-refundable. We may change our pricing or plans on a going-forward basis, and we will provide reasonable notice of material changes that affect your current plan.

7. Intellectual Property

The Service, including its software, design, and content (excluding your data and the data from your connected accounts), is owned by TrendPilot and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access and use the Service in accordance with these Terms. You retain all rights to your own data. You grant us the limited rights necessary to store and process your data solely to provide and improve the Service, consistent with our Privacy Policy.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data or insights will be accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

9. Limitation of Liability

To the maximum extent permitted by law, TrendPilot and its directors, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless TrendPilot from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your data or connected accounts, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will survive.

12. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in British Columbia for any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after any change indicates your acceptance of the updated Terms.
